404Diary 利用規約 (ToS)

1. はじめに

404Diaryは、日常の何気ない瞬間や感情を写真として残し、共有するための場所です。すべての利用者が心地よく過ごせるよう、以下のルールを定めます。

2. 投稿の禁止事項

以下の内容を含む画像の投稿を禁止します。

わいせつ・不適切な表現: 公序良俗に反する性的、暴力的な画像。
権利を侵害する物: ブランドロゴ、キャラクター、意匠権や商標権を侵害する恐れのある物品が主役となっている画像。
無断の人物撮影: 他者の顔など、個人が特定できる画像。ただし、写っている本人から明示的な許諾を得ている場合はこの限りではありません。

3. 写真の著作権と利用

著作権の帰属: 投稿された写真の著作権は、引き続き投稿した本人に帰属します。
個人利用の認可: 本サイトに投稿された写真は、閲覧者が「個人で楽しむ目的（デバイスの壁紙にする、私的に保存するなど）」に限り、保存して利用することを認めます。
商用利用の禁止: 投稿者の許可なく、写真を販売したり、広告や商用サイトへ無断転載したりすることは固く禁じます。

4. 管理者の権限

投稿の削除: 本規約に違反していると管理者が判断した場合、またはサイトの空気感を著しく損なうと判断された場合、予告なく投稿を削除することがあります。
規約の変更: 本規約は、より良い場所作りのために必要に応じて変更されることがあります。

5. 免責事項

投稿された画像によって生じたトラブル（第三者との権利侵害など）について、当サイトは一切の責任を負いかねます。投稿は自己責任において行ってください。

2. Prohibited Content

The following types of content are strictly prohibited:

Inappropriate or Explicit Material: Any images that are sexually explicit, violent, or otherwise offensive to public order and morals.
Infringement of Rights: Images where the primary subject is a branded logo, character, or any item that may infringe upon trademarks or design rights.
Unauthorized Portraits: Images that identify specific individuals without their explicit consent.

3. Copyright and Usage

Ownership: Copyright of the posted photos remains with the original uploader at all times.
Personal Use: Visitors are permitted to save and use photos from this site solely for personal, non-commercial purposes (e.g., as device wallpapers or for private collections).
Commercial Use Prohibited: Selling, redistributing, or using these photos for commercial purposes or advertisements without the uploader’s permission is strictly forbidden.

4. Administrator Rights

Removal of Content: The administrator reserves the right to remove any post without prior notice if it is deemed to violate these terms or significantly disrupt the site’s atmosphere.

5. Disclaimer
